Solicitors Qualifying Examination (SQE) - SQE1 Functioning Legal Knowledge (FLK) Mock Test
Overview of the SQE1 Functioning Legal Knowledge (FLK) Exam
The Solicitors Qualifying Examination (SQE) is the new centralised assessment for all aspiring solicitors in England and Wales, introduced by the Solicitors Regulation Authority (SRA). It replaced the Legal Practice Course (LPC) as the primary route to qualification. The SQE is divided into two parts: SQE1, which assesses Functioning Legal Knowledge (FLK), and SQE2, which assesses practical legal skills.
This mock test focuses specifically on the SQE1 FLK component. Passing SQE1 is a prerequisite for taking SQE2. The exam is designed to test a candidate's ability to apply fundamental legal principles and rules to realistic client-based scenarios. It ensures that all qualifying solicitors possess a consistent, high standard of legal knowledge relevant to contemporary practice.
SQE1 FLK Syllabus
The SQE1 FLK exam is split into two distinct assessments, FLK1 and FLK2, each covering a specific set of subject areas. Each FLK assessment consists of 180 multiple-choice questions (MCQs), meaning a total of 360 MCQs across both. The subjects are intricately linked, often requiring an understanding of how different areas of law intersect in practice.
FLK1 covers:
- Business Law and Practice: Formation of businesses, corporate governance, financing, insolvency, and taxation.
- Dispute Resolution: Litigation process, alternative dispute resolution, and evidence.
- Contract Law: Formation, terms, vitiating factors, performance, and remedies.
- Tort Law: Negligence, trespass, nuisance, and remedies.
- The Legal System of England and Wales: Structure of courts, legal professions, and sources of law.
- Constitutional and Administrative Law and EU Law: Fundamental principles, human rights, judicial review, and the impact of retained EU law.
- Ethics and Professional Conduct: Integrated across all areas, testing ethical behaviour and professional responsibility in legal practice.
FLK2 covers:
- Property Practice: Conveyancing processes, landlord and tenant, and property finance.
- Wills and the Administration of Estates: Will validity, intestacy rules, and probate.
- Trusts: Creation, types, duties of trustees, and remedies.
- Criminal Law and Practice: Offences against the person, property offences, general defences, and criminal procedure.
- Land Law: Estates and interests in land, registered and unregistered land, co-ownership, and easements.
- Ethics and Professional Conduct: Also integrated across all subjects, ensuring ethical considerations are paramount.
Candidates must demonstrate an integrated understanding, meaning they should be able to apply ethical principles and professional conduct rules within the context of any of the legal practice areas.
Test Rules
- Multiple Choice Questions (MCQs): All questions are single-best-answer MCQs. You must select the single best option from five possible answers.
- No Negative Marking: There is no negative marking for incorrect answers, so it is always advisable to attempt every question.
- Closed Book: The SQE1 FLK exam is closed book. No materials are allowed, except those provided by the SRA/test centre (e.g., pens, scratch paper).
- Identification: You must bring valid photographic identification (e.g., passport, driving licence) to the test centre.
- Timing: Each FLK assessment (FLK1 and FLK2) is 2 hours and 33 minutes long. There is a scheduled break between the two assessments.
- SRA Regulations: All SRA assessment regulations and test centre rules must be adhered to strictly. Any breach may lead to disqualification.
Scoring and Passing Marks
The SQE1 FLK is graded on a pass/fail basis. The SRA sets a pass mark for each assessment (FLK1 and FLK2) based on a sophisticated standard-setting methodology involving qualified solicitors. This method ensures that the pass mark reflects the standard expected of a newly qualified solicitor.
Candidates receive a single overall mark for FLK1 and a single overall mark for FLK2. A percentage score is provided, indicating how well a candidate performed relative to the maximum possible score. While there isn't a fixed percentage pass mark publicly announced (as it can vary between sittings), candidates must achieve at least the minimum standard set by the SRA for both FLK1 and FLK2 to pass SQE1. Results are typically released several weeks after the exam sitting.
Preparation Tips
- Understand the Syllabus: Thoroughly review the SRA's detailed assessment specification for SQE1 to understand the depth and breadth of knowledge required for each subject area.
- Integrated Learning: The SQE1 requires an integrated understanding. Don't study subjects in isolation. Practice applying cross-disciplinary knowledge, especially integrating ethics.
- Practice MCQs: The format of the SQE1 is unique. Regular practice with SQE-style multiple-choice questions is crucial to familiarise yourself with the question types and time constraints. Focus on identifying the single best answer.
- Time Management: With 180 questions per assessment and limited time, effective time management is key. Practice answering questions quickly and accurately under timed conditions.
- Focus on Application: The SQE is not about rote memorisation but about applying legal principles to factual scenarios. Think like a practising solicitor, considering the client's position and potential solutions.
- Review Ethics: Ethical considerations are pervasive. Ensure you have a strong grasp of the SRA's Principles and Code of Conduct, and how they apply in different contexts.
- Use Quality Resources: Utilise SRA-endorsed materials, reputable legal textbooks, and high-quality mock exams to guide your study.
- Identify Weak Areas: Use practice tests to identify your weaker subject areas and dedicate extra study time to them. Don't neglect any part of the syllabus, as all areas can be tested.
Good luck with your SQE1 FLK preparation!
